My office frequently transfers DUI cases from Justice of the Peace Court to the Court of Common Pleas located in the New Castle County Courthouse. In my opinion, Common Pleas judges are fair and favorable to Defendants. My office usually would opt for a bench trial versus a jury trial in the Court of Common Pleas.

The Delaware Family Court's criminal jurisdiction extends to all juvenile matters, crimes against juveniles and domestic violence matters.
