The Leonard L. Williams Justice Center formerly known as the New Castle County Courthouse is located at 500 North King Street Wilmington, DE 19801. A majority of the criminal cases in Delaware are heard in the New Castle County Courthouse in Wilmington. The following Courts for New Castle County are located in Wilmington, Delaware.

Court of Common Pleas

The Court of Common Pleas has jurisdiction over misdemeanor crimes and holds preliminary hearings for felony cases. The Court of Common Pleas is located on the fifth floor of the courthouse. Court of Common Pleas judges are all lawyers. All misdemeanor DUI cases that are heard in the New Castle County Courthouse are heard in the Court of Common Pleas. My office frequently transfers DUI cases from Justice of the Peace Court to the Court of Common Pleas located in the New Castle County Courthouse. In my opinion, Common Pleas judges are fair and favorable to Defendants. My office usually would opt for a bench trial versus a jury trial in the Court of Common Pleas.

Family Court

Family Court is located on the first floor of the New Castle County Courthouse. The Delaware Family Court’s criminal jurisdiction extends to all juvenile matters, crimes against juveniles and domestic violence matters. In Family Court, a judge or commissioner will always hear your case; there are no jury trials.

Superior Court

The Superior Court is located in the New Castle County Courthouse on the fourth floor. The Superior Court has exclusive jurisdiction to hear all felonies and drug offenses. The Superior Court also hears appeals from the Court of Common Pleas. When you have a case in Superior Court your courtroom number will be posted on a bulletin board on the fourth floor.

Appearing at the New Castle County Courthouse for Your Criminal Case

Criminal cases are scheduled at various times throughout the day. Make sure you arrive on time and dress appropriately for Court. Give yourself ample time to park and go through security. My advice to clients is NOT to wear shorts, low cut tops, and make sure you minimize exposure of your tattoos. There is a parking garage attached to the New Castle County Courthouse. The courthouse is open Monday through Friday from 8:30 a.m. to 4:30 p.m. The main phone number to the courthouse is 302-255-0900. The courthouse includes the Superior Court, Family Court, Court of Chancery, Court of Common Pleas, Adult Probation and many other occupants. When you walk in the main entrance there are televisions that have the calendars of the various courts in the building. However, the easy way to find out where you are going is to inquire at the information desk in front of security. The attendants are very helpful and will get you to the right place. For criminal cases, the Superior Court is located on the fourth floor and the Court of Common Pleas is on the fifth floor. Domestic Violence or protection from abuse cases are heard on the first floor.
